Protocolo Mundial del Agua: Nuevo Nombre para el Saqueo

Organizada por el Foro Político Mundial, que dirige MIJAIL GORRBACHOV, y con la colaboración del Parlamento Europeo a partir de la propuesta del Instituto Europeo de Investigación Sobre la Política de Aguas (IERPE), se realizó en BRUSELAS durante el 12 y 13 de febrero de 2009 la “CONFERENCIA HACER LA PAZ CON EL AGUA.”
En ella se abordaron entre otros temas “los reservorios de agua dulce más ricos del mundo en el Siglo XXI: CANADÁ, CONTINENTE LATINOAMERICANO y RUSIA”; la situación crítica ocasionada por la contaminación de los recursos hídricos de EE UU, INDIA y CHINA, los problemas de AFRICA, (sic) y las regiones donde existen y se desarrollarán guerras por el agua: “el MEDITERRANEO y MEDIO ORIENTE (del MEDITERRANEO al ASIA CENTRAL pasando por el ASIA ANTERIOR).”
El motivo de la misma fue la elaboración de un PROTOCOLO MUNDIAL DEL AGUA (PME) para impedir la contaminación de los recursos hídricos y prevenir los conflictos en torno a la propiedad y acceso al agua. El mismo estará centrado “en la prevención de conflictos, la promoción del derecho al agua para todos y la salvaguardia del patrimonio hídrico mundial (léase Patrimonio de la Humanidad) a través de una gestión responsable y eficaz del agua que es un bien común.” La idea es establecer un inventario de leyes jurídicas y políticas - institucionales de naturaleza cooperativa transnacional para prevenir y resolver los conflictos. Apunta a la creación de una AUTORIDAD MUNDIAL DEL AGUA, coordinada con la ONU para resolver los conflictos , regular la utilización del recurso y aplicar sanciones, que vele por la parte normativa y judicial, que ponga límites al uso del agua como mercancía. Establece que los estados deben asumir el control del agua, pero acepta las concesiones a empresas privadas.
El PROTOCOLO será presentado en la CONFERENCIA DE COPENHAGUE en diciembre de 2009 y luego en el año 2013 cuando se trate un nuevo Acuerdo post KYOTO. Desde el Foro Político Mundial se ha dicho que recoge las demandas de diferentes los foros mundiales, entre ellos el del Agua y de la Asamblea Mundial del Agua. Hagamos un poco de memoria. El Foro Político Mundial fue creado en el año 2002 como una organización a mitad de camino entre el Foro Económico Mundial de Davos y el Foro Social Mundial de Porto Alegre.
Participan en el mismo ex presidentes y primeros ministros, representantes de la Organización Mundial de Comercio (OMC), economistas, expertos en cuestiones sociales, representantes de organizaciones no gubernamentales. El Foro Mundial del Agua es organizado por el Consejo Mundial del Agua (WWC), fundado en 1996 por los gobiernos de los países ricos y organizaciones internacionales y transnacionales con actividades en el sector agua.
Elabora las visiones globales para el abastecimiento mundial de agua y asesora a los tomadores de decisiones en cuanto a la política internacional de agua. Su membresía coincide con la del el Patronato Mundial del Agua (GWP), llamado también Asociación Global del Agua, fundado en 1997 y que es apoyado financieramente por los gobiernos de Europa, Canadá, Banco Mundial, Programa de Naciones Unidas para el Desarrollo (PNUD) y la Fundación Ford. Su objetivo es “apoyar a países en el manejo sostenible de los recursos hídricos”, entendiendo como tal la conversión del agua en una mercadería y la apertura del sector para actores privados. Ambas entidades fundaron a fines del 2001 el Foro Mundial para el Financiamiento de Infraestructura de Agua (WPFWI) entre cuyos miembros, aparte de transnacionales del agua como Suez, encontramos a bancos regionales de desarrollo como el Banco Europeo para la Reconstrucción y el Desarrollo (EBRD) y el Banco Asiático para el Desarrollo, bancos privados, y a la multinacional Thames Water. El ex presidente del FMI, Michel Camdessus es uno de sus integrantes más importantes.
Todos estos actores han elaborado planes para apropiarse de los bienes naturales que sus países ya no poseen porque los han dilapidado, pero que sí poseen naciones y pueblos del mundo. Uno de estos planes ha sido, utilizando el pretexto de la “conservación de la naturaleza “ y de otorgar dinero para el desarrollo de esa “misión”, tratar de convencer a los pueblos del mundo de las bondades de aceptar el concepto “Patrimonio de la Humanidad”. Cuando una zona rica en bienes naturales como el agua, biodiversidad, selvas, bosques, minerales e hidrocarburos es declarada “Patrimonio de la Humanidad”, el país al cual pertenece pierde soberanía sobre ella. Esto implica desmembramiento territorial y dejar que “el zorro cuide a las gallinas”, pues se abren las puertas para la exploración y explotación de los bienes, bajo el pretexto de “preservarlos”, a los países ricos, organismos financieros y económicos mundiales y a las empresas transnacionales. La UNESCO informó que hay Sitios de Patrimonio Mundial, es decir regiones del mundo bajo esta denominación, con importante valor hídrico: Angalean Tenge en Filipinas, Angkok en Camboya, Monumentos Egipcios, Xochimilco y Centro Histórico en la Ciudad de México, también la ciudad de Potosí en Bolivia.
Pero también hay otros Sitios: Cataratas del Iguazú en Argentina y Brasil, Glaciar Perito Moreno, Valle de la Luna, Península de Valdés y Quebrada de Humahuaca en Argentina, Hielos Continentales en Argentina y Chile. Todas zonas con recursos hídricos superficiales y subterráneos, y minerales. En total son 166. Sin embargo; el proceso no es irreversible aún. Sólo basta la decisión política de un pueblo y de sus gobernantes para que la situación quede sin efecto. No sigamos comprando espejitos de colores.
La TERCERA CONFERENCIA DEL MAR, realizada entre los años 1973 / 1982 en Nueva York, Caracas, Ginebra, y a la cual asistieron la mayoría de los países del mundo, adoptó la Resolución 2749 de la ONU que estableció que los fondos marinos y sus recursos minerales son “Patrimonio común de la Humanidad”; y creó la AUTORIDAD INTERNACIONAL DE FONDOS MARINOS cuya misión es administrar los recursos, conformada por 35 países, y la EMPRESA para la exploración y explotación de los minerales, transporte, tratamiento y comercialización de los mismos. En 1980 EE UU autorizó por ley a empresas norteamericanas para explorar y explotar los recursos minerales de los fondos marinos situados fuera de la jurisdicción nacional y en 1982 anunció que no firmaría el TRATADO porque contiene disposiciones inaceptables sobre la explotación de las riquezas mineras del fondo del mar y se opone a los objetivos propios de EE UU.
Cabe preguntarse: ¿Quiénes son los países que poseen los medios económicos y tecnológicos necesarios para efectuar dichas exploraciones y explotación? La respuesta es obvia: las naciones más ricas. ¿Creen los países y pueblos que integran lo que alguna vez se llamó el “Tercer Mundo” y hoy se denomina “Hemisferio Sur”, países que están en vías de desarrollo o son subdesarrollados, que ellos compartirán con nosotros las ganancias de la comercialización de las riquezas mineras del mar cuando éstas sean explotadas, si es que no lo están siendo ya? ¿Piensan los países del Hemisferio Sur que podrán desarrollar en algún momento la capacidad tecnológica para llegar a los fondos marinos donde se encuentran estos bienes, extraerlos y llevarlos a tierra firme? ¿Piensan que llegará el momento en que puedan tomar parte de esta explotación generalizada?
El espacio es “Patrimonio de la Humanidad”. Nuevamente son los países ricos, aquellos agrupados bajo el nombre de “Grupo de los 7” aunque a veces son ocho, los únicos que están en condiciones de realizar las exploraciones espaciales. ¿Han compartido y comparten con nosotros su tecnología, el fruto de sus investigaciones, la totalidad de la información que poseen? ¿Han invitado a nuestros pueblos a participar de esas actividades? ¿Nos han invitado a formar parte de las misiones espaciales tripuladas? ¿Desde cuándo estas grandes naciones que ocupan el centro de los grandes escenarios mundiales están dispuestas a compartir el fruto de estas exploraciones y posibles explotaciones de los bienes de otros planetas, inclusive la luna, con el resto de los países? ¿Desde cuándo tienen rostro humano? Yo no lo conozco.
Las Naciones Unidas tienen su CONSEJO DE SEGURIDAD que ¡oh vaya casualidad está integrado por estas naciones! ¿Cuándo este CONSEJO ha votado a favor de los pueblos del “Tercer Mundo” o del “Hemisferio Sur” o en vías de desarrollo o subdesarrollados, como nos llaman, constantemente agredidos por ellos, las empresas transnacionales y organismos financieros y económicos internacionales y cuándo no, desestabilizados e invadidos, bajo falsos pretextos, por sus fuerzas armadas, que violan todos los derechos humanos y cometen verdaderos crímenes de guerra y de lesa humanidad contra niños, mujeres y hombres, y contra quienes resisten a la invasión de su territorio porque saben que la impunidad para ellos sí existe? Basta con recorrer las páginas de la historia reciente para tener una idea. Basta con mirar el presente: Haití, Iraq, Afganistán, Palestina…. Un poco más atrás: la ex - Yugoslavia, Vietnam, los pueblos africanos luchando por su independencia, la guerra sucia y el bloqueo, que continúa en el presente, contra Cuba, el bombardeo a Libia, la invasión de Granada, y Panamá. Sin olvidar los intentos de desestabilización a Venezuela, Bolivia, Ecuador y a muchos países de África, las constantes amenazas a Irán y Corea del Norte; y los bombardeos al norte de Pakistán. Y la lista continúa.
Las Resoluciones de la Asamblea General de la ONU 523 del 12 de enero de 1952, 626 del 21 de diciembre de 1952, 131 del 12 de diciembre de 1953 por la que se creó la “Comisión de la Soberanía Permanente sobre los Recursos Naturales”; 1515 del 15 de diciembre de 1960, que recomienda “que se respete el derecho soberano de todo Estado a disponer de su riqueza y de sus recursos naturales” y 1803 del 14 de diciembre de 1962, reconocen el derecho inalienable de los países y pueblos sobre sus bienes naturales. Sobre todo esta última es clarísima al respecto. Establece que cualquier medida tomada con respecto a la recomendación de la Resolución 1515 “debe basarse en el reconocimiento del derecho inalienable de todo Estado a disponer libremente de sus riquezas y recursos naturales en conformidad con sus intereses nacionales, y en el respeto a la independencia económica de los Estados,”…… “los acuerdos económicos y financieros entre los países desarrollados y los países en vías de desarrollo deben basarse en los principios de igualdad y del derecho de los países y naciones a la libre determinación.” … “… la prestación de asistencia económica y técnica, los préstamos y el aumento de las inversiones extranjeras deben llevarse a cabo sin sujeción a condiciones que pugnen con los intereses del Estado que los recibe.”…. “…. El ejercicio y el robustecimiento de la soberanía permanente de los estados sobre sus riquezas y recursos naturales fortalecen su independencia económica.” Determina en los Artículos 1: “El derecho de los pueblos y de las naciones a sus riquezas y recursos naturales debe ejercerse en interés del desarrollo nacional y del bienestar del pueblo del respectivo Estado.”; 2: que toda tarea de exploración y desarrollo de los recursos deben conformarse a las reglas y condiciones que los pueblos y naciones imponen; 3: que las empresas extranjeras se regirán por “la ley nacional vigente y el derecho internacional” y no deben “restringir por ningún motivo la soberanía de tal Estado sobre sus riquezas y recursos naturales; 4: “La nacionalización, la expropiación o la requisición deberán fundarse en razones o motivos de utilidad pública, de seguridad o de interés nacional, los cuales se reconocen como superiores al mero interés particular o privado, tanto nacional como extranjero… En cualquier caso en que la cuestión de la indemnización dé origen a un litigio, debe agotarse la jurisdicción nacional del Estado que adopte esas medidas.”; 5: “El ejercicio libre y provechoso de la soberanía de los pueblos y las naciones sobre sus recursos naturales debe fomentarse mediante el mutuo respeto entre los Estados basado en una igualdad soberana.”; 6: “La cooperación internacional en el desarrollo económico de los países en vías de desarrollo ….se basará en el respeto de su soberanía sobre sus riquezas y recursos naturales.”; 7: “La violación de los derechos soberanos de los pueblos y naciones sobre sus riquezas y recursos naturales es contraria al espíritu y a los principios de la Carta de las Naciones Unidas y entorpece el desarrollo de la cooperación internacional y la preservación de la paz.”; 8: “… los Estados y las organizaciones internacionales deberán respetar estricta y escrupulosamente la soberanía de los pueblos y naciones sobre sus riquezas y recursos naturales de conformidad con la Carta y los principios contenidos en la presente resolución.”
Sostienen que si el PROTOCOLO no se aprueba el mundo corre el riego de asistir a la ausencia de un acuerdo específico intergubernamental sobre el agua en el plano mundial; o por el contrario, serán los grandes grupos industriales, comerciales, energéticos y agroalimentarios quienes regularán los problemas mundiales que se presenten por la apropiación del recurso. Ambas premisas son absolutamente falsas. La pregunta es ¿quién está en condiciones de superar todas las barreras? ¿De quiénes son los grandes grupos económicos, empresariales y financieros? Nuevamente el lobo se pone la piel de cordero y es este disfraz de protección el que le permite, llegado el momento, una explotación sin control del bien natural ajeno que desea poseer.
Como he desarrollado en mi libro “LAS GUERRAS DEL AGUA” (Tomo I: “Un recurso escaso en peligro”, Capital Intelectual, Claves para Todos, Buenos Aires, 2008) existe legislación universal para prevenir los conflictos que pueden presentarse por los recursos hídricos superficiales transfronterizos : La “Convención sobre el Derecho de los Usos de los Cursos de Aguas Internacionales para Fines Distintos de la Navegación” establecida por las NACIONES UNIDAS en el año 1997; y desde el 11 de diciembre de 2008, también por los recursos hídricos subterráneos compartidos: “Convención de las Naciones Unidas sobre los Acuíferos Transfronterizos”, dentro del marco del “Proyecto de Convención sobre los Recursos Naturales Compartidos”.
Por su parte, la Comisión de Derecho Internacional de la ONU ha establecido cinco Principios Rectores para evitar conflictos armados por los recursos hídricos compartidos: 1) La utilización equitativa del recurso. 2) La prevención de perjuicios importantes a otros estados, aplicado a los cursos internacionales .3) La obligación de notificar e informar. 4) La gestión cooperativa de los ríos compartidos. 5) La obligación de resolver las disputas en forma pacífica.
Conviene agregar que “ Las Convenciones de Ginebra”, adoptadas en el año 1949, y sus “Protocolos Adicionales”, adoptados el 8 de junio de 1977, establecen claramente la protección de los civiles y los bienes que se consideran indispensables para la supervivencia de la población, entre ellos el agua y los recursos e instalaciones hidráulicas destinadas al uso civil, en cualquier conflicto armado.
No quiero olvidarme de la “Carta Mundial de la Naturaleza”, aprobada y adoptada por las NACIONES UNIDAS en la 48 Sesión Plenaria de la Asamblea General, el 28 de octubre de 1982, que reconoce también la soberanía plena de los estados sobre sus bienes naturales y advierte: “la competencia por acaparar recursos escasos es causa de conflictos…” “… la conservación de la naturaleza y de los recursos naturales contribuye a la justicia y al mantenimiento de la paz, pero esa conservación no estará asegurada mientras la humanidad no aprenda a vivir en paz y a renunciar a la guerra y los armamentos.”… “Los principios enunciados en la presente Carta se incorporarán según corresponde en el derecho y la práctica de cada Estado y se adoptarán también a nivel internacional.”
El 26 de noviembre de 2002, la ONU, a través del Comentario General 15, establecido por el Comité sobre Derechos Económicos, Sociales y Culturales del Consejo Económico y Social de las Naciones Unidas, reconoció que “el agua es un derecho indispensable para llevar una vida con dignidad humana y un prerrequisito para la realización de otros derechos humanos”. Afirmó además que “el derecho humano al agua, da derecho a todos a tener agua suficiente, segura, aceptable, físicamente accesible y a precios razonables para uso personal y doméstico”. Determinó también que los gobiernos tienen la obligación de garantizar el acceso a agua limpia y servicios de saneamiento adecuados a toda la población, promover prioritariamente el abastecimiento para uso doméstico, prohibir la quiebra en los sistemas existentes de abastecimiento de agua, decidir por sí mismos si estas tareas se implementan pública o privadamente y hacer todo lo posible para que los organismos financieros y económicos internacionales como el Banco Mundial, FMI y Organización Mundial de Comercio (OMC) reconozcan el derecho humano y medioambiental al agua, lo cual no ha sucedido hasta hoy. La paradoja es que la misma ONU ha defendido las políticas de privatización del agua. Hoy hay nuevamente consenso en que el agua no es una mercadería La contrapartida de estas frases y conceptos es que la comercialización del agua potable, embotellada, en bidones, mineralizada, ha llegado a cifras que son inimaginables y ha alcanzado las regiones más alejadas del planeta. Es un comercio que supera a cualquier otro comercio apto para la vida humana. Así nos encontramos por un lado los derechos, y por otro, la cruda realidad que viola estos derechos.
Acceder al agua es un derecho humano fundamental ligado a la salud y a la vida. Es un bien social, inalienable, que debe ser objeto de políticas de servicio público (estado nacional, provincial, municipal, cooperativas de usuarios). El Estado debe garantizar prioritariamente el acceso de toda la población al recurso hídrico; una vez cumplida esta meta, debe asegurar el agua necesaria para la agricultura y ganadería, y por último para la industria. El agua, en suma, es patrimonio de los pueblos y países donde el recurso se encuentra. Y no debemos olvidar que la Historia ha demostrado y demuestra que el pueblo, el país que no ejerce soberanía efectiva y real sobre sus bienes naturales (agua, selvas, bosques, biodiversidad, minerales, hidrocarburos) para explorarlos y utilizarlos en beneficio propio, cuidándolos para que puedan ser disfrutados por las generaciones venideras, en armonía con la tierra y la naturaleza, estará siempre de rodillas ante los organismos financieros y económicos internacionales, ante las empresas transnacionales y la potencia imperial de turno. Sólo el pueblo , el país que es dueño de sus bienes naturales, es realmente libre, independiente, autónomo y soberano.
Muchas organizaciones sociales y personas han comprado, algunas de buena fe, esta idea pergeñada en los círculos de poder mundial de un PROTOCOLO MUNDIAL DEL AGUA. Los cantos de sirena llevan a la destrucción, saqueo, devastación y muerte. No nos olvidemos. Como bien dijo JOSÉ MARTÍ: “¡Los árboles se han poner en fila para que no pase el gigante de las siete leguas!”
