La Defensa de la Democracia
La Honorable Cámara de Representantes de la Nación Paraguaya, sanciona con fuerza de Ley.
Artículo 1º.- Los que se alzaren a mano armada contra los poderes constituidos para suplantar total o parcialmente la organización democrática republicana de la Nación, por el sistema comunista o cualquier otro régimen totalitario, sufrirán la pena de cinco a diez años de penitenciaría.
La proposición, conspiración y la instigación formal para cometer este delito, serán castigadas, cuando vayan acompañadas de actos preparativos con la mitad de dicha pena.
Art. 2º.- Serán reprimidos con la pena de seis meses a cinco años de penitenciaría:
1º) Los que difundieren la doctrina comunista o cualesquiera doctrinas o sistemas que se propongan destruir o cambiar por la violencia la organización democrática republicana de la Nación.
2º) Los que organizaren, constituyeren o dirigieren asociaciones o entidades que tengan por objeto visible u oculto cometer el delito previsto en el inciso precedente:
Art. 3º.- Serán castigados con penas de tres meses a dos años de penitenciaría:
1º) Los que formaren parte como asociados o afiliados de alguna de las asociaciones a que se refiere el artículo anterior:
2º) Los que proporcionaren cualquier ayuda económica o material para realizar o facilitar las actividades previstas por el artículo 2º.
3º) Los que a sabiendas arrendaren o proporcionaren locales destinados a efectuar las reuniones y actividades a que se refiere dicho artículo.
4º) Los que con el mismo objeto mantuvieren relaciones, o recibieren instrucciones, dádivas o auxilios de cualquier clase que fueren de gobiernos, organizaciones o personas extranjeras o residentes en el extranjero, y los que entregaren, distribuyeren o hicieren circular estas instrucciones o auxilios.
5º) Los que introduzcan, impriman, mantengan en depósito, distribuyan, vendan o de cualquier modo difundan folletos, revistas, láminas, periódicos, películas cinematográficas, o cualquier impreso o elementos de propaganda de las doctrinas o sistemas a que se refiere el Artículo 2º.
Art. 4º.- Se aplicará la pena de dos meses a un año de penitenciaría a los que, a sabiendas, concurrieren a mitines o reuniones secretas, de las organizaciones mencionadas en el Artículo 2º o de personas que ejercieren las actividades indicadas en dicho artículo.
Art. 5º.- Los que a sabiendas se suscribieren a elementos de propaganda a que se refiere el artículo 3º inc. 5º serán reprimidos con uno a seis meses de penitenciaría.
Art.6º.- Se impondrá penitenciaría de uno a seis meses al que ostentare emblemas, banderas o distintivos de las organizaciones o entidades mencionadas en el art. 2º.
Art. 7º.- Los funcionarios públicos encargados de la prevención y la persecución de los delitos previstos en esta ley, que omitieren deliberadamente o por negligencia tomar las providencias respectivas para evitar la comisión de dichos delitos o que teniendo conocimiento de ellos no tomaren las medidas necesarias para la detención y enjuiciamiento de los culpables sufrirán las penas de destitución, penitenciaría de seis meses a cinco años e inhabilitación absoluta de dos a cinco años.
Art. 8º.- Si alguno de los delitos previstos en esta ley se cometiere por medio de la prensa, la radiodifusión o agencia de noticias o informaciones, la publicación, radio-emisora o agencia será suspendida por un período de uno a seis meses y clausurada en caso de reiteración o reincidencia, sin perjuicio de la sanción penal que corresponda a los culpables, y los libros, folletos, periódicos, proclamas o cualesquiera impresos serán decomisados.
Art. 9º.- El miembro de las Fuerzas Armadas o Policiales de la Nación que difundiere la doctrina comunista o las doctrinas o sistemas a que se refiere el Art. 2º sufrirá, además de las penas correspondientes, la pérdida de su estado.
Art. 10º.- Ninguna institución pública ni servicio mantenido por el Estado o los Municipios, o empresas que tengan a su cargo servicios públicos, podrá tener funcionarios, empleados u operarios que estén afiliados ostensible o secretamente al Partido Comunista o a las otras organizaciones a que se refiere esta ley, o que hubiesen cometido alguno de los delitos previstos por ella.
Art. 11º.- El Poder Ejecutivo clausurará cualquier establecimiento particular de enseñanza que no excluya de su personal directivo docente o administrativo, a los que estén afiliados ostensible u ocultamente a las organizaciones ilícitas a que se refiere esta ley, o que hubiesen incurrido en alguno de los delitos penados por ella.
Art. 12º.- Si los delitos previstos en esta ley se cometieren en tiempo de guerra o de conmoción interna o en período de peligro inminente de cualquiera de ellas, las penas serán elevadas hasta el doble.
Art. 13º.- Los extranjeros naturalizados que cometieren algunos de los delitos contemplados en esta ley perderán la ciudadanía paraguaya y podrán ser expulsados del país. Esta última medida se adoptará contra los extranjeros no naturalizados, sin perjuicio en ambos casos, de la imposición de las penas correspondientes.
Art.14º.- Los funcionarios públicos que incurrieren en alguno de estos delitos sufrirán destitución, y además de las penas respectivas, inhabilitación absoluta por un tiempo doble del de duración de la condena.
Art. 15º.- La reiteración y la reincidencia de estos delitos serán penados conforme a las disposiciones pertinentes del Código Penal relativas a los delitos comunes.
Art. 16º.- Los delitos previstos en esta ley no darán lugar a la excarcelación provisional, bajo fianza, ni a substitución de pena salvo la conmutación de la misma por el destierro dispuesta por el Poder Ejecutivo.
Art. 17º.- Créase un Juzgado de 1ra. Instancia y una Agencia Fiscal en lo Criminal para entender privativamente en los delitos previstos por la presente Ley.
Art. 18º.- Deróganse todas las disposiciones contrarias a esta Ley.
Art. 19º Comuníquese al Poder Ejecutivo.
