Leyes Antiterroristas
El Tablero de la intervención de Estados Unidos en América Latina

Para entender en toda su dimensión el significado de la aprobación de leyes antiterroristas en diversos países de América Latina, como sucedió en Argentina en junio de 2007, se hace necesario un rápido recuento de la política imperial y colonial de Estados Unidos en nuestro continente y en el mundo.
Desde el nefasto período de la expansión de fines del siglo XIX y principios del XX hasta la actualidad, América Latina no ha logrado desprenderse definitivamente de la dependencia colonial o neocolonial de Estados Unidos. Los pueblos de América Latina también fueron victimas de la guerra entre potencias por los territorios y para asegurarse Estados Unidos la total hegemonía en la región, después de anexarse extensos territorios de nuestro continente.
En esta larga historia de intervenciones y colonialismos varios que sería difícil resumir llegamos hasta el final de la Segunda Guerra Mundial, lo que significó el comienzo de un nuevo período donde América Latina- que siempre intentó caminos de liberación- quedó atrapada en los diseños de la Guerra Fría y en las doctrinas surgidas de los semilleros de los viejos y renovados poderes imperiales.
Nuestra región quedó atrapada en el esquema de un imaginario “occidente” supuestamente cristiano y un “oriente” –inmenso por cierto- y ya en los finales de los años 40, a la vez que se creaban organismos internacionales para supuestamente establecer mecanismos de justicia mundial, en Washignton se desarrollaron una serie de aparatos de inteligencia y control, como la CIA y otras instituciones similares.
También Estados Unidos se apoderó del control real de la Organización de Estados Americanos (OEA) y de los ejércitos de América Latina, que quedaron supeditados mediante la Junta Interamericana de Defensa, a la dirección de Washington. A grandes rasgos esto se institucionalizó con la creación del Comando Sur, ubicado hasta fines de 1999 en la zona colonial del Canal de Panamá.
Bajo el concepto de “solidaridad continental” Washington diseñó la Doctrina de Seguridad Nacional, en defensa de sus intereses económicos, políticos y militares, y todos nuestros países quedaron bajo esa éjida “para la contención por todos los medios del avance comunista”. En este diseño surge el esquema de la contrainsurgencia, que facultaba todo tipo de acciones ilegales lo que confluyó al trazado de la Guerra de Baja Intensidad (GBI).
En los años 70, al salir derrotado en Vietnam y ante la efervescencia de América Latina, en el Cono Sur, Estados Unidos volvió con toda su fuerza hacia nuestra región. Aquí tenían a verdaderos ejército coloniales- que de eso se trataba la instrucción que recibían nuestros militares en las Escuelas estadounidenses- que pusieron al frente de los gobiernos dictatoriales sembrados en casi todos los países de América Latina.
Las consecuencias de las dictaduras de la Seguridad Nacional (de Estados Unidos),fueron los miles de muertos, perseguidos, desplazados, un verdadero genocidio regional. Todas las víctimas fueron asesinadas en nombre de la “lucha contra el terrorismo” entonces “pro soviético”. La contrainsurgencia se había probado con eficiencia mortal en los escuadrones de la muerte que iniciaron tempranamente su vida en América Central en los años 30.
El genocidio del siglo XX en América Latina fue cometido por las necesidades e intereses de Washington, lo cuál había quedado trazado tempranamente en 1823 con la Doctrina Monroe donde se definió que “América(era) para los americanos”(léase norteamericanos). Hoy casi dos siglos después esa Doctrina encabeza los documentos coloniales de nuevo cuña, como el Santa Fe IV (ver sección Documentos Estrategias de Dominación).
A lo largo de los años 90 Estados Unidos impuso y creó renovados mecanismos de control y espionaje con acuerdos logrados a espalda de los pueblos. Mientras se diseñaba y aplicaba el “Consenso de Washington”, paradigma de la dictadura económica global de los años 90, también se reciclaba en términos nuevos y más abarcativos, no sólo en lo militar, sino en lo político, ecónomico, cultural, diplomático y hasta religioso el esquema de la Guerra de Baja Intensidad de los años 80.
Los nuevos trazados de la GBI fueron previstos para los conflictos de los años 2000 donde se predecía que iba a estallar el tema de las deudas externas, los problemas sociales, la agitación en el campo y sectores indigenistas, entre otros, ante el agravamiento del desempleo y las consecuencias que dejaría la aplicación del modelo neoliberal a ultranzas.
Esto definía la “necesidad” de estar en el terreno antes que estos conflictos estallaran para controlarlos mejor. El correlato de esta doctrina que extendía -con elementos y estrategias más elaboradas – la doctrina de Seguridad Nacional o el término hitleriano de las insaciables ”fronteras seguras”, es la GBI.
Así el poder militar estadunidense se extiende por América Latina y el mundo a la sombra de nuevos argumentos y en apoyo del sistema económico dominante. La dinámica de la GBI permite su adaptación a cualquier necesidad del poder mundial. Como los países más pobres del mundo son identificados con el mal, el destino de toda la región se está jugando en los tableros militares.
Los años 90 fueron de intensas acciones para enfocar la “lucha antiterrorista” con absoluta dependencia de los mandatos de Washington. Y a mediados de esa década se había comenzado a presionar para instalar las nuevas legislaciones en nuestros países y la Ley Antiterrorista era uno de sus principales objetivos.
Coincidiendo con la urgencia de llenar el vacío que significaba la desaparición de la Unión Soviética la nueva estrategia puede leerse en letras de molde en el Documento Santa Fe IV, donde se avanzaba el nuevo esquema de seguridad hemisférica para estrangular a América.
Algunos ejemplos y antecedentes
Sólo para recordar algunos datos en Argentina, Carlos Corach, el entonces ministro del interior del ex presidente Carlos Menem (1989-1999), fue uno de los personajes más activos en la organización de estos nuevos planes, trazando con la CIA, el FBI y otras agencias similares los paquetes de medidas políticas y operativas tendientes a “eliminar y erradicar focos de terrorismo y narcotráfico” en planes “conjuntos” contra los supuestos asentamientos “fundamentalistas”. Se referían a los radicados en la Triple Frontera de Argentina, Brasil y Paraguay, y mencionaban entre otras organizaciones supuestamente terroristas a Hezbollah , guerrilla libanesa nacida para resistir la invasión israelí al Líbano en los años 80.
El gobierno de Menem había acordado con Estados Unidos una alianza estratégica, profundizando el alineamiento con Washington. En 1995 fue presentado en la cámara de diputados un proyecto de ley sobre lucha contra el terrorismo, habilitación de figuras especiales para combatirlo, la creación de la dirección de protección a los testigos, víctimas e informantes y agentes infiltrados en organizaciones entre otros.
Esta ley sería aplicada a los delitos “que puedan ser considerados de naturaleza terrorista y a lo previsto en el artículo 210 bis del Código Penal que fueran cometidos en el territorio de la nación argentina o en los lugares sometidos a su jurisdicción”.
El Art. dos, por ejemplo decía que “se considerarán de naturaleza terrorista los delitos cometidos con explosivos, sustancias incendiarias, armas u otros medios aptos para causar estragos o la muerte o grave daño en el cuerpo o en la salud de un indeterminado número de personas...cuando tuvieran como propósito atemorizar a la población o a cierto grupo de personas, o producir represalias de carácter social o religioso u obtener alguna medida o concesión por parte de cualquier miembro de los poderes públicos”. Ésto,entre otros artículos, daba cuenta del proyecto de control regional más descarnado que hoy está lamentablemente en vigencia con la nueva Ley Amtiterrorista y cierto disfraz de lenguaje.
Ya en 1996 en Estados Unidos se sancionaba el Anti-Terrorism & Effective Death Penalty Act, donde se modificaba y ampliaba su propia definición de terrorismo, tal como figuraba en el Acta de Inmigración y Nacionalidad. Para, supuestamente,"frenar el financiamiento de organizaciones terroristas" se amplió las facultades de la Secretaría de Estado y se definía como “terrorista” a quien cometiera actos que fueran considerados contra la “seguridad nacional” de Estados Unidos.
Lo que tratamos de demostrar es que la acción estadounidense para obligar a la firma de las Leyes Antiterroristas era y es parte de otros proyectos que funcionan en conjunto y permiten ganar terreno en la invasión silenciosa que por distintos medios se sucede en el continente.
El atentado -de oscuro origen hasta ahora- que derrumbó las Torres Gemelas en Nueva York en septiembre de 2001, sirvió a Washington para poner en marcha todo lo planeado en los años anteriores supuestamente para combatir en primer término el narcotráfico, el lavado de dinero, el narcoterrorismo o el terrorismo a secas.
Al acusar inmediatamente a “fundamentalistas islámicos” del hecho terrorista- sin ninguna prueba fehaciente- favorecía las posiciones de su principal socio, el gobierno ultraderechista de Israel, que necesitaba apresurar el control de Medio Oriente y una “limpieza” regional.
Bush puso en marcha la llamada Doctrina de la Guarra Preventiva y bajo ese manto se lanzó a la ocupación ilegal de las principales cuencas de recursos estratégicos, además ponía en escena a un enemigo nuevo, extraordinario, ambiguo, difuso y rápidamente ubicable en cualquier lugar en que sus necesidades imperiales lo demanden. El presidente estadounidense anunció también la guerra infinita y sin límites, desconociendo todos los principios de legalidad internacional y aplicó al interior de su país el Acta Patriótica(US Patriotic Act), promulgada el 24 de octubre de 2001, que nos revela el trasfondo del diseño de las Leyes Antiterroristas que terminaría imponiendo en nuestros países.
La lista de violaciones a los derechos humanos que escenifica la “Patriotic Act”, es inmensa. No sólo significó poner bajo control y vigilancia- con impunidad total- a la población estadounidense, con posibilidad para los servicios de inteligencia de invadir la propiedad privada, anular las autonomías universitarias, permitir las cárceles secretas, los jueces sin rostro, la detención y desaparición por tiempo indeterminado de sospechosos, pasibles de ser interrogados con los métodos que sus captores crean necesarios. También autorizaba- en los superpoderes al gobierno- mantener campos de concentración como los de Guantánamo, el secuestro de cualquier persona tanto en Estados Unidos como en todo el mundo, su traslado ilegal de un país a otro, sin posibilidad de defensa. Es posible aplicar castigos a los abogados que intentan defender a los prisioneros y que pueden ser incluidos en las listas de los sospechosos.
El Acta Patriótica posibilita todo tipo de acción ilegal sin que se deba rendir cuenta ante ninguna institución. La acusación de “sospechoso” de terrorismo o de pertenecer a alguna asociación, aunque sea absolutamente pacífica, o que tenga lazos familiares o de nacionalidad con quien se considere “enemigo” , trasforma a un ser humano en un tipo de víctima similar a la de los campos de concentración de la Alemania nazi y permanecer - como sucede en Guantánamo – detenido desaparecido todo el tiempo que sus captores decidan, sin justicia alguna, violando la constitución propia.
El 13 de septiembre de 2001 el Senado de la Unión autorizó al gobierno a emplear la fuerza contra naciones, organizaciones y personas que en su criterio tuvieran alguna relación con los atentados, aún sin prueba alguna.
La Ley Antiterrorista o Acta Patriótica aprobada por el Congreso amplió las facultades del presidente y los órganos policíacos y de inteligencia para limitar o desconocer los derechos civiles.
En el diseño del Acta Patriótica se incluyó por supuesto el esquema del acta de 1996, marcando las penalidades para los supuestos financiadores del “terrorismo” en una serie de actividades, incluyendo a las culturales. Al considerar a varias organizaciones guerrilleras o revolucionarias o movimientos populares o sociales o de derechos humanos o gobernantes díscolos, como “ejes del mal”, cualquier financiación para publicaciones culturales puede ser impunemente confiscada bajo la acusación de servir para algún tipo de “asociación terrorista”.
El Acta Patriótica ha posibilitado un sistema de control informático que no sólo deja a los estadounidenses sin posibilidad de defensa de sus mínimos derechos civiles sino que abarca al mundo entero.
Así con esta Ley como una guadaña sobre la cabeza del pueblo estadounidense aterrorizado y sin oposición alguna,se ordenó la invasión a Afganistán en 2001 en una acción ilegal, marcada por sus necesidades geopolíticas.
No le fue bien en la guerra de Afganistán, porque la resistencia abarcó a diversos sectores de la población, y a pesar del silencio cómplice de Europa sobre el genocidio cometido allí y el apoyo de la OTAN, están empantanados.
Se continuó con la invasión y ocupación de Irak en el año 2003 donde ya se estiman más de 800 mil muertos. El país está destruido y la situación militar es un pantano. Se reconoce públicamente que esa guerra ilegal fue hecha por el petróleo y por el control de un territorio estratégico en Medio Oriente.
Ante el pantano de Irak, en el 2006 comienza nuevamente a reactivarse todo el esquema geoestratégico de recolonización de América Latina, que está simbolizado por el Plan Colombia, el Plan Puebla Panamá y sus sucedáneos y por el Area para el Libre Comercio de las Américas (ALCA) y ahora el Plan Mérida o Plan México.
El 30 de marzo de 2005 la Cámara de diputados de Argentina aprobó dos leyes contra el terrorismo reclamada por Estados Unidos abriendo un camino oscuro, porque el conjunto de las normas pueden favorecer la instalación de formas dictatoriales o gobiernos de facto. Una de esas iniciativas convertida en ley es el Convenio Internacional para la Represión del Financiamiento al Terrorismo, adoptado por la Asamblea de la Organización de Naciones Unidas (ONU) en diciembre de 1999 en Nueva York.
La otra fue la Convención Interamericana Contra el Terrorismo adoptada por la asamblea de la OEA en Bridgetown, Barbados, en junio de 2002. Esto sucedió bajo una escalada de presiones que incluyó una gira del ex secretario de Defensa estadounidense, Donald Rumsfeld, por la región.
Así, la iniciativa estadounidense de alinear a América Latina en su política antiterrorista, un trazado típico similar a lo que se impuso durante el reinado de la Doctrina de Seguridad Nacional,(de Estados Unidos) en el marco de la llamada “Guerra Fría” y que sembró de dictaduras el continente- resultó en una metodología clásica para establecer un nuevo tiempo de control de toda la región.
Estados Unidos se transformó en un imperio que busca imponer el totalitarismo globalizado y necesita controlar a los gobiernos y someter a los organismos internacionales,como la ONU, el FMI, el BM, entre otros.
En los dos últimos años, además de avanzar en la ocupación militar a través de bases o pequeñas estructuras de tropas especiales, maniobras y otros mecanismos, presionó duramente a los gobiernos regionales para imponer las Leyes Anti-terroristas votadas en los últimos tiempos en varios países.
La lucha antiterrorista está sirviendo de pretexto, para que EEUU vulnere todos los derechos humanos, políticos, civiles y sociales. Para nosotros es un deber de dignidad y sobrevivencia impedir que bajo la pantalla de estas leyes antiterroristas, impuestas por un estado terrorista mundial, nuestra región se vea atrapada en otro tiempo de horror y destrucción. Debemos resistir todo proceso de recolonización, porque tenemos derecho a un siglo XXI de liberación.
